Marbella streamlines building licences to cut approval times

Marbella is simplifying its building licence process with new planning instructions that cut approval times and improve certainty for construction, renovation and development projects.

Applying for a building licence in Marbella is about to get much faster

For anyone planning to build, renovate or invest in property in Marbella, there’s some good news! The process is about to get much faster. Long waits for licences can delay projects, increase costs and introduce uncertainty, particularly in a market where demand remains strong and construction calendars are tightly planned.

In recent news, a newly-approved urban planning instruction by Marbella City Council marks an important step forward. The new framework is designed to significantly reduce processing times for building licences, simplify procedures, and bring greater clarity to how applications are handled.

A clearer, faster licensing process

Approved by the Local Governing Board, the instruction introduces a more structured and consistent approach to how building permits are assessed. According to the council’s urban planning department, the objective is straightforward: fewer delays, fewer misunderstandings, and better communication between applicants and the administration.

At the heart of the update is a clear definition of what documentation is required for each type of project. By standardising technical criteria and introducing unified report templates, the council aims to eliminate the back-and-forth that often slows applications down. In practice, this means fewer contradictory interpretations within departments and a smoother path from submission to approval.

One correction, not many

One of the most notable changes is how incomplete applications are handled. Going forward, files that do not meet the minimum requirements will not be accepted, and only a single request for corrections will be issued. If that request is not addressed, the application will be withdrawn.

This measure is designed to prevent licences becoming stuck in administrative limbo and to encourage higher-quality submissions from the outset — a change that ultimately benefits both applicants and the municipality.

Expanded use of responsible declarations

The new instruction also strengthens the use of “responsible declarations”, a process that allows certain works to begin immediately once the required conditions are met, without waiting for a full licence approval.

Minor works with a budget under €10,000 — such as painting, cladding or specific interior installations — are now clearly defined as not requiring prior authorisation or payment of fees, except in specially protected areas like Marbella’s historic centre. This distinction removes uncertainty and allows small-scale projects to move ahead quickly and confidently.

Aligning local and regional regulations

Rather than adding another layer of bureaucracy, the instruction brings together existing legislation into a single, coherent framework. It systematises regional laws such as Andalucía’s Land Sustainability legislation, municipal ordinances on public-private collaboration, and national administrative procedure laws.

For applicants, this translates into clearer guidance on what applies to their project and why, an important step in improving legal certainty in the planning process.

Public-private collaboration to speed things up

The update works alongside Marbella’s ordinance on public-private partnerships, which allows certified external entities to replace certain municipal technical reports. This approach reduces pressure on local departments while maintaining oversight and standards, helping applications move through the system more efficiently.

Together, these measures position Marbella at the forefront of administrative streamlining in Andalucía, particularly at a time when construction activity and investment interest remain high.
